On December 10, 2010, the D.C. Court of Appeals lifted the Stay, and the cases against DOE can now go forward.

March 3, 2010, the U.S. DOE filed a motion (http://www.energy.gov/news/documents/DOE_Motion_to_Withdraw.pdf) to withdraw its pending license application for a geologic repository at Yucca Mountain. Several law suits have been filed against DOE and a question of whether it has the authority to withdraw the license application.  DOE requested a Stay on the cases until the NRC considers a related order.

On May 11, 2009, the NRC filed a Memorandum and Order (Identifying Participants and Admitted Contentions), allowing Inyo County and Other Entities to Intervene in the Yucca Mountain Nuclear Waste Repository Licensing Proceedings (dated May 14, 2009).

On January 15, 2009, the DOE filed an “Answer to Inyo County’s Petition to Intervene” and on February 9, 2009, the NRC Staff filed an “Answer to Intervention Petitions”.  Inyo County filed a “Response to the Answers of the DOE” on February 24, 2009.

On December 22, 2008, Inyo County filed a "Petition for Leave to Intervene" on a license application by the DOE for authority to construction a geologic high-level waste repository at Yucca Mountain, Nevada.

The Nuclear Regulatory Commission ("NRC") received an application from the U. S. Department of Energy ("DOE") on June 3, 2008, for a license to construct and operate the nation's first geologic repository for high-level nuclear waste at Yucca Mountain, Nevada. The License Application can be found on the DOE website at http://www.ocrwm.doe.gov.
